General conditions of purchase

This page regulates the conditions for using the website www.balliuexport.com and for purchasing products through it. For these general conditions, BALLIU refers to BALLIU EXPORT, S.A.; and “CUSTOMER” to the user of the website and possible online buyer. The Client accepts these General Terms and Conditions of Purchase, as well as by the Privacy Policy and the Cookies Policy. By using this website or purchasing products and/or service through it, the Customer consents to be bound by these Terms. If you do not agree with all of them, you should not use this website. These Conditions may be modified by BALLIU, as well as the privacy and cookies policies. The Customer is responsible for consulting them each time he/she accesses, browses and/or uses the website, as the conditions in force at the time of purchase will apply. The order may be placed at the Customer’s choice in any of the languages available on the website: Spanish, Catalan, English and French. In case of discrepancy in the interpretation, the
clause in Spanish language will prevail.

The client

Before contracting and during the purchase process, the Customer can access, file and print these general conditions. All personal data provided by the Customer will be treated in accordance with the Privacy Policy of BALLIU. The Customer declares that the information provided is truthful. If all the necessary information is not provided, the order cannot be processed. The Customer agrees not to place false or fraudulent orders; BALLIU may cancel them and take appropriate legal action. The Customer must be over 18 years of age and have the legal capacity to enter into contracts. In the case of legal entities, those acting on their behalf must ensure that they are adequately represented and that the information provided is truthful. BALLIU shall not be liable for any damages, losses or losses related to these statements.

Orders

To place an order, the Customer must select the products on the BALLIU website and create a virtual shopping basket. Before placing the order, the Customer must:
1. Read and understand the product descriptions on the website. If in doubt, they should contact BALLIU by email or telephone.
2. Read and understand the technical specifications of the products available in the product information on the website.
3. Check the price of the products and any promotions, ensuring they are aware of the final price including VAT and delivery charges.

Availability

The delivery time for products is 7 to 10 working days from September to February, and may be 14 to 20 days from March to August. If a product runs out of stock during the ordering process, BALLIU will inform the Customer and deliver the product within a longer timeframe at no extra cost.

Price and payment

Prices include VAT and are current at the time of purchase, including any applicable promotions. Prices exclude delivery charges, which will be added before payment. Prices are subject to change, but such changes will not affect orders that have already been confirmed. Accepted payment methods are credit/debit card and bank transfer. Credit cards are subject to verification and authorisation by the issuing bank. If payment is not authorised, BALLIU shall not be liable for any delays or failure to deliver, and shall not be able to formalise the contract with the Customer. For payments by bank transfer, the order is held for 2 calendar days to allow the transfer to be processed. If payment is not received, the order will be cancelled. All payment charges shall be borne by the Customer and added to the total amount. The Customer must ensure that they enter the exact order amount, the account number and the transfer reference correctly. In the event of an error, the order will be cancelled. BALLIU is not liable for the inaccuracy of the details provided by the Customer or for any damage to third parties resulting from the unlawful use of payment methods; it is not possible to pay for the purchase of the products or the service in any manner other than that provided for.

Billing

Once the purchase process is complete, billing details cannot be changed. The Customer will receive a paper or digital invoice along with the goods.

Delivery

All shipping costs, taxes and customs duties are payable by the Customer. Once dispatch has commenced, the Customer will receive a tracking code for small parcels. For large-volume orders, please contact BALLIU by email or telephone. The Customer must pay for the services at the time of booking and must be present at the delivery address or appoint someone to receive the delivery. Delivery will be made in accordance with the Incoterm FCA clause. This means that BALLIU will bear the risk of loss, damage, breakage or destruction of the product until the goods are made available at the point agreed with the Customer. Liability is transferred to the Customer once BALLIU has made the goods available to them at the agreed point.

Delivery time: BALLIU will dispatch the order within the timeframe agreed with the Customer and within a maximum of 30 days. Delivery shall be deemed complete when the Customer, or a designated third party, physically receives the products and signs the delivery note provided by BALLIU or the carrier. If delivery cannot be made on the agreed date, BALLIU will contact the Customer to reschedule. If the Customer changes the delivery address, additional costs may apply.

Rescheduling of delivery: If BALLIU is unable to deliver on the agreed date and time, the order will be returned to the warehouse and BALLIU will contact the Customer to arrange a new delivery. If the Customer is absent on the agreed date, they must pay the delivery charge again, unless it is BALLIU’s fault, in which case BALLIU will cover the cost of the next delivery.

If the Customer changes the delivery address or is not present at the agreed date and time, an additional charge may apply. Balliu will inform the Customer of this charge before proceeding, so that the Customer may accept it. The following documents form part of these general terms and conditions of purchase:
• Purchase receipt.
• Document/order form detailing the contracted services, prices and date of provision.
• Any other attached document signed by the parties.
By accepting these terms and conditions, the Customer authorises the service to be provided by third parties designated by BALLIU.

Customer obligations

Payment: Pay for the services upon booking, in accordance with the prices stated in the order.
Attendance: You must be at home to receive the delivery, or arrange for someone else to be there.
Accurate details: Ensure that the details provided are accurate. Please provide a contact telephone number.
Delivery restrictions: Deliveries to PO boxes or public locations are not permitted. If a second delivery is required due to incorrect details, the Customer must pay the additional cost.
Signing the delivery note: Please sign the delivery note once the service has been completed and note any issues in the relevant section.

Checking the goods: Check the quantity and condition of the packages received and note any damage on the delivery note.
Claims for hidden damage: Please report any hidden damage within 2 days of delivery. Submit a written claim and, if possible, photos of the damage, by email to [email protected].
Delivery location requirements: Please ensure that the delivery location meets the necessary requirements and notify us of any obstacles that may hinder delivery. If we are not informed and a second delivery is required, the Customer will be liable for the cost of this without a refund for the first delivery, and may incur storage charges.
Responsible use: The Customer is responsible for using the products in accordance with the technical specifications and instructions, and for ensuring that the location of the product within the premises complies with all regulations and requirements.

Withdrawal

The Customer has 14 calendar days from receipt of the last of the products purchased in the same order to exercise the right of total or partial withdrawal. To return, you must contact BALLIU by email. The refund will be issued via the same payment method used for the original purchase. Once we have received the returned item and checked its condition, we will refund the amount paid for the item within a maximum of 14 days. The item must be returned in perfect condition, showing no signs of use, and in its original packaging. The Customer is responsible for the diminished value of the products due to handling other than necessary, which means that the exercise of the right of withdrawal is not allowed in these cases. To exercise these rights and guarantees the Customer must present the proof of purchase of the products. The Customer shall bear the direct cost of returning the products, except in the event of a dispatch error or a defective product on the part of BALLIU. Furthermore, the Customer shall be responsible for arranging the return shipment by whatever means they deem appropriate, and must retain proof of dispatch at all times. BALLIU will not accept returns sent carriage forward nor will it arrange collection, unless prior written agreement has been reached. Returns of personalised products (not listed in the catalogue) or made-to-measure items will not be accepted.

Warranty

Products purchased on this website are covered by the warranty described in the Warranty Policy.

Applicable law and jurisdiction

This contract is governed by Spanish law. Any disputes shall be settled in the courts of Girona, Spain.
