Balliu Export S.A., with registered office at Ctra. C-35, Km. 93.5, 17455 – Caldes de Malavella, guarantees its products as follows:

– Warranty on the chassis and frame of their products: 3 years from the date of the invoice.
– Exclusive warranty on the frame and structure of the Eva Pro and Eva Pro T sun lounger models: 5 years from the date of the invoice.

The warranty applies to all countries in which the products are supplied by authorised distributors of Balliu Export S.A. This warranty does not cover defects caused by the passage of time or normal wear and tear (for example, discolouration or flaking of the paint, scratches, cracks, etc.). Nor shall the warranty apply in cases of misuse, improper use of the product, improper handling of the product, deterioration of the product due to obstructive or corrosive external agents, or due to inadequate maintenance, lack of cleaning or the use of non-original brand spare parts, etc.

Nor shall this warranty cover defects resulting from adverse weather conditions, natural disasters or wars, or any other circumstances of a similar nature. Labour costs associated with the fitting of broken or damaged parts are not included. The warranty provided by Balliu Export S.A. shall be limited to the supply of parts which it considers and accepts to have a manufacturing defect or to have broken during use under the terms described above, with no delivery charges payable by the customer.

In addition, Balliu Export S.A. guarantees all the fabrics used in its products against tearing, colour changes or fading caused by ultraviolet rays, provided that they have been used and maintained in accordance with Balliu Export S.A.’s recommendations, for a period of three years. During this period, in the unlikely event that the fabric tears, changes colour or fades whilst being used as recommended, Balliu Export S.A. will supply the fabric to the customer free of charge. Labour costs for fitting the fabric are not included.

This additional fabric warranty shall not apply in cases of misuse, improper use of the product, tampering with the product, damage to the product caused by obstructive or corrosive external agents, or due to inadequate maintenance, lack of cleaning, or the use of non-original brand spare parts, etc. Nor shall this warranty cover defects resulting from adverse weather conditions, natural disasters or wars, or any other circumstances of a similar nature.

Should it be necessary to replace the fabric on the furniture, Balliu Export S.A. accepts no liability for minor differences in the colour of the fabric. Should the exact model of the product be unavailable because it has been discontinued, Balliu Export S.A. will replace it with a similar product.

Provisions common to both warranties: These warranties do not cover products that are damaged due to negligence or that, once they have left the premises of Balliu Export S.A., are damaged, tampered with, mishandled, misused or stored in an inappropriate manner.

Once the parts and/or fabric have been supplied, the warranty will not be extended; the product will remain covered for the duration of the warranty originally provided. The label, which shows the production batch number, must remain attached to the furniture and/or fabric for the warranty to remain valid.

The customer must notify Balliu Export S.A. of all warranty claims within two weeks of the date on which they arise, and must also provide the following documents:
– A copy of the original invoice.
– Photographs clearly showing the defects.
– The product units covered by the claim.
– Date of manufacture (labels, clock, etc.).
– Label attached to the furniture and/or fabric.
– Defective part or parts.

Once this documentation has been received, Balliu Export S.A. will, if it deems it to be valid, immediately dispatch any spare parts required to resolve the claim. Any spare parts or products resulting from repair requests not covered by the warranty will be invoiced to the customer by Balliu Export S.A.

The warranty expressly excludes any faults or malfunctions arising as a direct or indirect consequence of the addition of parts or components not belonging to the manufactured product, or the replacement of original parts supplied by Balliu Export S.A. with parts not supplied by Balliu Export S.A. The manufacturer accepts no liability for any direct or indirect losses, costs or damages of any kind resulting from defects in the products. This warranty does not affect the rights available to the owner in accordance with the provisions of Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Protection of Consumers and Users.
